Foreword to the German Plant Safety Ordinance

On 31 July 2002, the German federal cabinet approved the Ordinance for Legal Simplification in the Field of Safety and Health Protection in the Provision of Equipment and its Use at the Workplace, on Safety in the Operation of Systems subject to Compulsory Monitoring and on the Organisation of Corporate Occupational Safety (article ordinance).

 

On 3 October 2002, the “Ordinance on Safety and Health Protection in the Provision of Equipment and its Use at the Workplace, on Safety in the Operation of Systems subject to Compulsory Monitoring and on the Organisation of Corporate Occupational Safety (BetrSichV)” dated 27 September 2002 came into force (BGBl. I S.3777).

 

The BetrSichV lays down that systems subject to compulsory monitoring within the meaning of § 2 Para, 2a of the German Equipment Safety Act are equated with equipment as from 1 January 2003.

At the same time, on 1 January 2003 the German Steam Boiler Ordinance, the Pressure Vessel Ordinance, the Elevator Ordinance, the Acetylene Ordinance and the Ordinance on Electrical Systems in Explosion-Hazard Areas are repealed in their entirety. The Ordinance on Flammable Liquids and the Beverage Dispensing System Ordinance are repealed in certain areas.
